Long Island Foreclosure Defense

The sub-prime mortgage meltdown has hit the Long Island and New York area hard. You may feel that your mortgage bank is your enemy. You fall behind and get calls day and night. You try to make a mortgage payment and they send it back. They won't work with you. They might inflate the amount due.

What would you do if you found out your mortgage company was trying to take back your home by lying, or trying to pull a fast one, or violating the law?

Just Because You Fall Behind and the Bank Starts Foreclosure Doesn't Mean You Lose.

The truth is that many banks do not bring foreclosure proceedings the correct way, and you have powerful state and federal laws that can protect you. Most people do not know them. For example:

• The mortgage company suing you may not be the same one that loaned you the money in the first place. The mortgagee who brought the foreclosure suit may not have the right to foreclose!

• Long Island foreclosure laws require banks and mortgage companies to fill out foreclosure papers in a very specific way. If your mortgage company failed to do so, then you may be able to have the foreclosure proceeding dismissed!

• Often a mortgagee will claim that you owe more than you really do, by loading up with bogus fees and inflating amounts. These are valid defenses!

• Lenders are required to adhere to important consumer protection laws. If they don't, you may have defenses under the Truth in Lending Act, or the Real Estate Settlement Procedures Act. or other laws!

• Some lenders make promises that they will re-finance your loan after a period of time, and then refuse to do so. If that happens to you, you may be able to defend your foreclosure proceeding because the mortgagee induced you to enter the mortgage by fraud!

• Many consumers are victims of predatory lending. Lenders give them mortgages that they cannot afford. If you are a victim of predatory lending, you may have a viable defense!

Foreclosure Defense through Foreclosure Litigation May Help

Craig D. Robins, Esq. is an experienced bankruptcy attorney, practicing for over twenty years. He has helped many people save their homes by protecting their consumer rights with bankruptcy. However, in reviewing so many mortgages, he has learned that there are often successful defenses that can be asserted in a foreclosure proceeding. There are many techniques for legally and properly holding back the foreclosure proceeding to give you time to catch your breath.

We can help you fight your foreclosure. Chapter 7 or Chapter 13 Bankruptcy may be your best option but it is not a one-size-fits-all deal. It is not for everybody.

If you have been sued in foreclosure, or if a foreclosure summons and complaint was left at your door, then your time is limited and you must act immediately. Once the foreclosure starts, you only get 20 or 30 days to file papers with the court. Your chance to fight back becomes more difficult once that clock runs down. That's why you need to call the Law Offices of Craig D. Robins now.
